Council has approved the introduction of an infringement regime for Parking, Warrants of Fitness and Registration as provided for in Land Transport (Road User) Rule 2004.
This introduction would provide a consistent approach to dealing with offences across the regulatory spectrum. This would also allow Council an opportunity to improve community convenience and safety.
The Ticketing Process
A parking enforcement officer will issue an infringement ticket when the user of a motor vehicle has committed an offence.
A ticket is legally served when it is:
- Placed under the vehicles windscreen wiper.
- Handed to the driver.
- Posted to the last known registered address.
Infringement notices will show:
- Details of your vehicle
- Date and time infringement was issued
- Location where vehicle was parked at the time
- Alleged offence
- Fee payable
- Notes to defendant are printed on the reverse side of the ticket.
Compliance/14 Day Diversion
Council introduced a compliance period of 14 days for warrant of fitness and vehicle registration offences, which means that the infringement will be waived if compliance is achieved.
Transfer Liability of a Vehicle Infringement
If you have received a Vehicle Infringement Notice and you believe that another person is responsible, for example, if your car had been stolen at the time or you had sold it, then you can apply to have liability for the alleged offence transferred from you to the other person.
Print and complete the relevant Statutory Declaration to Transfer Liability form explaining why you think you are not liable for this infringement, for example if your car was stolen or you recently sold it.
Before you sign the form and add the date and place, you need to find an authorised witness (Justice of the Peace, Solicitor, Registrar / Deputy Regisrar of the Court).

Appoint a Person to Act on Your Behalf
If you wish, you can name another person and give them authority to act on your behalf to deal with Kawerau Council about one or more specific Infringement Notices.
- You need to complete an Authority to Act on my Behalf form.
- This Authority to Act is only for the Infringement Notices listed on the form.
- You can cancel this Authority to Act at any time by contacting the Council.
- While the Authority to Act is in effect, the Council will act on the instructions of your nominated person when dealing with the listed Infringement Notices
- While the Authority to Act is in effect, the nominated person has authroity to access your personal information that is held by the Kawerau Council.
- The Kawerau Council is not responsible for any actions of your nominated person using this Authority to Act.
